  1. ELIGIBILITY: The 2008 Alltel My Circle 500 Promotion (the “Promotion”) is open only to legal residents of the 50 United States (including District of Columbia), who are 18 years of age or older at time of entry. Void where taxed, restricted, or prohibited by law. People in any of the following categories are not eligible to become a Finalist or to participate as a guest of a Finalist: Current or former professional or semi-professional motorsports drivers, crew members, or coaches. Documentation may be required to determine Finalist and guest eligibility, or alternate will be selected. Employees of Alltel Communications, LLC (“Alltel”) (“Sponsor”); GMR Marketing LLC (“GMR”); Campbell-Ewald Company (“Campbell-Ewald”); Enpocket, a Nokia Company (“Enpocket”); and their affiliates, sales representatives, retailers, distributors, and promotion and other vendor agencies involved in this promotion, and the immediate family members (parent, child, sibling, spouse) of such employees, are not eligible. In the event of dispute as to the identity or eligibility of a potential Finalist based on a wireless telephone number or email address, the winning entry will be declared made by the “Authorized Account Holder” of the number submitted at the time of the entry (see Rule #6 for further information). Promotion is subject to all federal, state, and local laws and regulations.

 

  1. TIMING: The Promotion begins at 12:01 a.m. Eastern Time (“ET”) on February 24, 2008 and ends at 11:59 p.m. ET on May 3, 2008 (the “Promotional Time Period”). The Promotion consists of ten (10) weekly drawings (“Weekly Drawings”), with corresponding entry periods that end at 11:59 p.m. ET each Saturday from Sunday, February 24, 2008 to Saturday, May 3, 2008. All entries regardless of entry method must be received by 11:59 p.m. ET each Saturday of a Weekly Entry Period to be eligible for that week’s drawing. For Weekly Drawing schedule, refer to Rule #4 below. All non-winning entries received for a Weekly Drawing will be carried over into each subsequent drawing throughout the Promotional Time Period.

 

  1. HOW TO ENTER (two (2) ways to enter): (1) VIA TEXT MESSAGING: To enter the Promotion via text messaging on a text message-capable phone with the appropriate short-code capabilities, send a text message to the short code 38229. Certain prepaid customers may not be able to enter via text message. (2) VIA ONLINE: To enter the Promotion via the online method, visit www.alltelracing.com, complete an Official Online Entry Form, including your name, address, wireless phone number, alternate phone number, email address, verify age, accept the Official Rules and Alltel’s Privacy Policy, and click “submit” before 11:59 p.m. ET on May 3, 2008. Limit one (1) entry per person per day regardless of method of entry. All non-winning entries received for a Weekly Drawing will be carried over into each subsequent drawing throughout the Promotional Time Period. Entrant must include all data requested for the Promotion entry to be valid. No responsibility is assumed by Sponsor, GMR, Campbell-Ewald, Enpocket, or their respective affiliates and agencies for any computer or technical malfunctions that may occur.

 

  1. WEEKLY DRAWING DATES: There will be ten (10) Weekly Drawings from among all eligible entries received by 11:59 p.m. ET each Saturday during the Promotional Time Period. Each Weekly Drawing will occur approximately two (2) days after the entry deadline for that Weekly Drawing Entry Period. All drawings will be conducted in accordance with these Official Rules on Sponsor’s behalf by GMR, an independent judging organization whose decisions on all matters related the Promotion are binding and final. Non-winning entries will be carried over into each subsequent Weekly Drawing. Odds of winning depend on the number of eligible entries received by the respective drawing dates.

  1. PRIZES AND APPROXIMATE RETAIL VALUES:

Ten (10) Finalist Prizes will be awarded. One (1) Finalist Prize will be awarded to one winner (“Finalist”) in each of the ten random drawings from among all eligible entries received for the respective Promotional Time Period as described in Rule #4. Each Finalist Prize is as follows:

 

Trip for Finalist and up to ten (10) guests, but no fewer than seven (7) guests (collectively, “Group” or “Team”) to Charlotte, North Carolina, May 22, 2008 through May 26, 2008 to participate in the 2008 Alltel My Circle 500 Go-Kart Race and Pit-Crew Challenge (for details on the race and challenge events, see Rule #7 below). Trip includes: (i) roundtrip coach-class airfare for Group (from airport near Finalist’s and/or guest’s hometown at time of entry as selected at the discretion of Sponsor; ground transportation or other arrangements may be substituted at Sponsor’s discretion); (ii) four (4) nights hotel accommodations (hotel to be determined at the discretion of Sponsor) in double occupancy rooms, excluding meals, room service, or other incidentals; (iii) ground transportation to and from the Charlotte airport and hotel, and to and from the hotel and the activities for the Group; (iv) select meals, beverages, and VIP treatment for the Group (to be determined at the discretion of the Sponsor); (v) a possible opportunity for the Group to meet Ryan Newman and the #12 Alltel Dodge Team (subject to the not yet published race weekend schedule); and (vi) a behind the scenes tour of the Penske Racing shop for the Group. The Finalist only will also receive one wireless handset and accessory (wireless handset and accessory manufacturers and models to be determined solely by the Sponsor).

 

In addition, each Finalist, who individually and with his/her guests meets all eligibility and participation requirements in the Go-Kart Race and Pit-Crew Challenge (see Rules # 6 and 7 below), will also receive a single cash payment in the form of a corporate check, based on the actual retail value of the travel prize and a 34% tax rate (example: $12,991.09 cash payment on a $25,218 value travel prize), which is intended to assist with any federal, state, or other tax obligations related to the Finalist Prize. The Finalist is solely responsible for all federal, state, and local income taxes and other taxes associated with the Finalist Prize. Sponsor and GMR will comply with all tax reporting requirements.

 

The actual value of each Finalist Prize is expected to vary, based on the number of guests, point of origination, airfare fluctuations, and hotel pricing. If actual value of travel portion of prize is less than stated, difference will not be awarded in cash, and no such claim will be honored. If Finalist resides within 300 miles, alternate travel arrangements may be made by the Sponsor and/or the Finalist and value of prize and single cash payment adjusted accordingly. The Group may be required travel together from the same airport and on the same itinerary, as well as possess all required travel documents (e.g. valid government-issued photo ID) prior to departure. Travel route, hotel accommodations, transportation, activities, and all elements of the prize will be arranged by the Sponsor, in its sole discretion. Group is solely responsible for meals, souvenirs, taxes, gratuities, other ground transportation, and all other expenses not expressly specified herein. Prize is not transferable; no prize substitution or cash alternative is allowed except by Sponsor due to unavailability of prize. In all cases, Finalists will be responsible for all expenses associated with qualification for and receipt of the Finalist prize, specifically including federal, state, and local income taxes and other taxes. Sponsors will comply with all tax reporting requirements. Certain conditions and restrictions apply. No additional cash payment is included. The Approximate Retail Value (“ARV”) of the Finalist Prize is $38,209.09; however an actual retail value not to exceed that amount will be provided to each Finalist once arrangements are final.

 

  1. FINALISTS: For Finalist Prizes awarded by random drawing, the identity or eligibility of a selected potential Finalist will be based on a wireless telephone number or an email address and the winning entry will be declared made by the “Authorized Account Holder” of the number or email address submitted at the time of the entry. The “Authorized Account Holder” is the person to whom the applicable wireless service provider or Internet service provider, or other organization (such as business or educational institution) has assigned the telephone number and to whom the billing is directed and who is responsible for payment of the bill or the email addresses for the domain associated with the submitted email address. Documentation may be required to prove identity and/or eligibility. Any necessary alternate winners will be selected in a similar random drawing from among the remaining eligible entries received.

 

Potential Finalists selected by random drawing will be notified by phone/express mail to the address indicated on the entry on or about one (1) day following Finalist selection. Each Finalist must complete, sign, and return an acceptable affidavit of eligibility, mutually acceptable liability release, publicity release, and the appropriate tax documents (the “Documents”) within five (5) calendar days after notice is sent, or the prize will be forfeited in its entirety and an alternate winner will be selected, time permitting. If a Finalist is a minor in his/her jurisdiction of residence but 18 years of age or older (an “eligible minor”), the prize may be awarded in the name of, or to, the Finalist’s parent/legal guardian, who must agree to all obligations and undertakings of Finalist, both on behalf of himself/herself and Finalist, or prize may be forfeited and awarded to an alternate Finalist.

 

Finalist’s Guests: Each Finalist must designate all guests within five (5) calendar days of receipt of the Documents. The Finalist must identify up to ten (10) guests but no fewer than seven (7) guests. If the Finalist does not identify at least seven (7) guests, the prize will be forfeited in its entirety and an alternate winner will be chosen, time permitting. If fewer than seven (7) guests accompany the Finalist on the trip, all further activities and prizing for that Finalist and his/her guests will be terminated and forfeited. All guests must be 18 years of age or older. In addition, at the same time, all guests must sign and return an affidavit of eligibility, publicity release (where legal), mutually acceptable liability release, and any applicable tax documents. Any Finalist or guest who is an eligible minor must be accompanied on the trip by the guest’s parent or legal guardian, who will also be counted as and must participate as a guest and who must execute an affidavit of eligibility, a publicity release (where legal), and a mutually acceptable liability release for both him/herself and on his/her child’s behalf and accompany his/her child/legal ward on the trip.

 

No Finalist or guest will be allowed to compete on more than one team.

 

Publicity Release: Except where prohibited, acceptance of prize by Finalist and guest constitutes Finalist’s and guest’s consent that their name, likeness, voice, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.

 

  1. 2008 ALLTEL MY CIRCLE 500 GO-KART AND PIT-CREW CHALLENGE: The 2008 Alltel My Circle 500 Go-Kart Race and Pit-Crew Challenge (the “Event”) will be held Friday, May 23, 2008 and Saturday, May 24, 2008. The Challenge will be two-tiered and include (i) a Go-Kart Race and (ii) a Pit-Crew Challenge. Participation is mandatory for each Team and, in the Pit-Crew Challenge, for each Team member. Any Finalist or guest not participating as required will be disqualified from further prizing. Each of the Team members may be required to sign additional waivers or liability releases for the Go-Kart and Pit-Crew Challenge. All events will be timed to the thousandth of a second.
    1. Practice: On Friday, all Teams will attend pit stop training and be served lunch at the track.
    2. Go-Kart Race: On Saturday, the Finalists will participate in the Go-Kart Race at the PIT Instruction & Training facility in Mooresville, North Carolina. The designated track will be 0.25 miles long and oval in shape. All drivers will be allowed the same number of practice laps. Once the practice laps are completed, Ryan Newman will complete one (1) lap around with a running start, which will be timed by contest officials and deemed the established time for the Go-Kart Race. After Ryan Newman’s lap, each of the Finalists will take a turn on the track. During each Finalist’s turn, the Finalist will complete one (1) lap around with a running start, which will be timed by contest officials and deemed the Finalist’s Official Go-Kart Time.
    3. Pit-Crew Challenge: Following the Go-Kart Race, each Team will participate in the Pit-Crew Challenge at the PIT Instruction & Training facility in Mooresville, North Carolina. In the Pit-Crew Challenge, each guest on each Team will be required to participate in the Challenge and perform a pit-crew task on a full-size race car. The Pit-Crew Challenge tasks include, but are not limited to, tire changes, refueling, and windshield washing. Ryan Newman’s Pit Crew will execute the Pit-Crew Challenge and their time will be deemed the established time. Then each Team will compete and be timed, which will be the Team’s Official Pit-Crew Challenge Time. The Teams’ times will not be revealed to anyone until the final Team has completed the Pit-Crew Challenge.
    4. Grand, First, and Second Prizes: Upon completion of the Challenge, each Team’s Official Go-Kart Time and Official Pit-Crew Challenge Time will be added together and revealed and the Team with the lowest combined time will be declared the Grand Prize Winner and $200,000 cash Grand Prize will be awarded, the Team with the second lowest combined time will be declared the First Prize Winner and $10,000 cash First Prize will be awarded, and the Team with third lowest combined time will be declared the Second Prize Winner and $5,000 cash Second Prize will be awarded. In the event of a tie for the Grand Prize, First Prize, or Second Prize, the tied Teams will compete again in the Pit-Crew Challenge only in a rematch and the Team with lowest time will be declared the respective winner. If the Grand Prize Winning Team’s combined time in the initial round of competition (i.e., excluding any rematch) is less than the combined established times for Ryan Newman’s Go-Kart Race time and Ryan Newman’s Pit Crew’s Pit-Crew Challenge time and less than 44.000 seconds, an additional $300,000 cash prize will be awarded for a total Grand Prize cash award of $500,000. Only the Grand Prize Winning Team will be eligible for the additional cash prize. Regardless of its size, the Grand Prize, First Prize, and Second Prize will be awarded as follows: 50% (i.e, $100,000 cash prize or $250,000 cash prize) will be awarded to the winning Team’s Finalists and the remaining 50% will be awarded in equal shares to the participating guests on the winning Team. All winning Teams’ members, both the Finalist and guests, will be responsible for all expenses associated with qualification for and receipt of the Grand, First, or Second Prize, specifically including federal, state, and local income taxes and other taxes. Sponsors will comply with all tax reporting requirements. The Grand, First, and Second Prize winning Team’s members may be required to complete additional tax documents.

 

  1. ELECTRONIC AND ONLINE REGISTRATION: This Promotion is for viewing in the United States only. If you do not live in the United States, do not enter the Promotion. If for any reason the Promotion, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Promotion, Sponsor reserves the right at its sole discretion to disqualify any individual the Sponsor or GMR deems responsible and Sponsor further reserves the right to cancel, terminate, modify, or suspend the Promotion, with appropriate alternate method of prize award selected. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any email or entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Promotion. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Promotion entries generated by a script, macro, or other mechanical or automated means are ineligible and will be disqualified.

 

  1. BY ENTERING, entrant agrees to accept and abide by the rules of this promotion and agrees that any dispute with regard to the conduct of this promotion, rule interpretation, or award of prize, shall be submitted to GMR, whose decision shall be binding and final. By participating, entrant agrees to release and hold harmless Sponsor, GMR, Campbell-Ewald, Enpocket, their divisions, affiliates, sales representatives, distributors and promotion and other vendor agencies, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents, and representatives of any of the above organizations from any injury, loss, or damage to person, including death or property due in-whole or in-part, directly or indirectly to the acceptance or use/misuse of a prize, participation in any Promotion-related activity, or participation in the Promotion. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the promotion, or in the announcement of prizes. In the event Sponsor is prevented from continuing with this promotion, or the integrity and/or feasibility of the promotion is severely undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Promotion without further obligation. If Sponsor in its discretion, elects to abbreviate the promotion as a result of Force Majeure event, Sponsor reserves the right, but not the obligation, to award the prize from among all eligible entries received up to the date of such Force Majeure event. All entries are the property of the Sponsor and are not returnable. Sponsor, GMR, and their respective affiliates and representatives hereby disclaim any and all representations and warranties regarding the Promotion prizes, including warranties of merchantability and fitness for a particular purpose.

 

  1. ADDITIONAL TERMS: Text messages will be billed according to the customer’s existing rate plan. Only those messages confirmed to be sent or received will be applied to your bill. Text message billing detail is currently not available. Messages will be saved and delivery attempted for up to three (3) days. Alltel does not guarantee message accuracy, completeness or delivery. Text messages are neither monitored nor controlled for content, except for direction from Alltel. ALLTEL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE PROVIDED. Alltel reserves the right, in its sole discretion, to modify, terminate, or suspend the Promotion should viruses, bugs, unauthorized human intervention or causes beyond Alltel’s control, corrupt or impair the administration, security or fairness of the Promotion. Alltel reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Promotion, acting in violation of these rules, acting in an unsportsmanlike or disruptive manner or acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all entries submitted by such methods. The user identified in Sponsor’s billing system for any given wireless telephone number used to enter by sending a text message, will be deemed to be the participant and must comply with these rules. Only the number of prizes stated herein will be awarded. In the event any technical errors result in the apparent selection of more winners or award of more prizes than intended (in any prize category), Sponsor reserves the right to award the prizes by random drawing from among all eligible claimants (in that prize category).
